LANDLORD TRAINING & LICENSING

Since 23rd November 2016 individuals operating as Landlords in Wales need to follow new legislation in accordance with Part 1 of the Housing (Wales) Act 2014. Those Landlords found to be in contravention of the Law may be subject to penalties.

It is now necessary for ALL Landlords to have registered with www.rentsmart.gov.wales (a site run in conjunction with Cardiff City Council) confirming that they are operating as Landlords.

However, there are different requirements depending on the different types of Landlords, that is whether they:

  • privately market, Self-Manage and let their properties; or
  • let their properties through an agent (Let Only); or
  • appoint agents to manage their lets on their behalf (Managed Lets).

The more a property agent such as MGY is involved in managing a let, the more protection the Landlord gains.

Self-Managing/Private Landlords

Private Landlords, or those who Self-Manage their lets and do not involve a property agent, need to:

  1. Be Registered – They should have already registered themselves with Rent Smart Wales prior to 23 November 2016. Rent Smart Wales can be found here: https://www.rentsmart.gov.wales/en/security/login/?fdReturnURL=%2fen%2fdashboard%2f%3ffdSignup%3dtrue&fdSignIn=False&fdSignUp=True
  2. Be Trained – It is also mandatory that they attend training to ensure that they are aware of their legal and health safety obligations as a Landlord. Training dates and venues can be found on the Rent Smart Wales website here: https://www.rentsmart.gov.wales/en/training/
  3. Be Licensed – They should also have applied for a licence. More information on licensing can be found on the Rent Smart Wales site here: https://www.rentsmart.gov.wales/en/landlord/landlord-licensing/

Self-Managing or Private Landlords found to be operating without registration, a licence or training since the deadline of 23 November 2016, will be committing an offence and may be fined.

Let Only Landlords

Let Only Landlords, that is those who appoint property agents (such as MGY) to market their lets/find to their tenants but who manage the properties themselves, need also to:

Managed Lets

Those Landlords who appoint a property agent, such as MGY, to manage their lets in totality are the most protected from the law. This is because MGY is licensed and has received the required training to manage the property on the Landlord’s behalf.

Therefore, Managed Let Landlords need only:

All Landlords Should Stay Informed

MGY recommends that all Landlords stay up to date with their legal obligations and the relevant legislation by regularly visiting www.rentsmart.gov.wales. It is also advised that each Landlord seeks independent guidance from a legal advisor.
